Glenn, I don't think that's the question. The issue is whether Sirius Radio Sessions featuring bands are 'commercial releases' or not.

The answer to that is that I don't know, and I would suspect that you'd need to get permission from Sirius to do it, especially if it says 'You may not make commercial use of, reproduce, rebroadcast, or otherwise transmit our programming.'

However, I'm a general admin, and not an Etree admin - would any Etree admins like to weigh in on this?

So since there's no official response I'll take that as "we're not going to say yes or no." There are some XM shows available here, so I'll also assume the same will go for Sirius. The only reason I asked fist was to avoid any potential conflict between Sirius and The Archive. Thanks, B

Having checked with our Director of Collections, it sounds like the answer is - if a show is taped by a taper, there should be no problems. If it's 'professionally' taped in some way by a for-profit organization, then you would need to seek permission from that organization.

Sound sensible?
